Purchase Green Terms & Conditions

These Terms are a binding agreement between you and Purchase Green (“Purchase Green,” “we,” “us,” or “our”). If you do not agree, do not use the Services.

You must be at least the age of majority in your state or province to use the Services. You represent you are using the Services for lawful purposes and in compliance with all applicable laws.

• You are responsible for your account credentials and all activity under your account.

• Notify us immediately of any unauthorized use of your account or breach of security.

• Order Acceptance: We may accept, reject, or limit any order at our sole discretion.
• Pricing Errors: If a price or availability error occurs, we may cancel the order or contact you for instructions.
• Taxes & Fees: Prices exclude taxes, duties, and shipping unless stated otherwise.
• Payment: You authorize us and our payment processors to charge your selected payment method for all amounts due.
• Promotions: Promotions are subject to terms and may be modified or terminated at any time.

Shipping times are estimates and not guaranteed. Title and risk of loss pass to you upon our delivery to the carrier. Inspect packages upon receipt and promptly notify the carrier and us of any issues.

Returns and exchanges are governed by our Return Policy (if provided). Where required by law, you may have additional rights that cannot be disclaimed.

The Services, including all text, graphics, logos, images, and software, are owned by or licensed to Purchase Green and protected by IP laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or internal business use.

By submitting content, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, host, reproduce, modify, publish, and display such content in connection with the Services and our business, in any media now known or later developed.

You represent you have all rights necessary to grant the foregoing license and your content does not infringe or violate any third-party rights or laws.

• No unlawful, harmful, or fraudulent activity.
• No interference with the security or operation of the Services.
• No automated scraping, data mining, or reverse engineering except as permitted by law.
• No infringement of intellectual property or privacy rights.

Third-party sites and services are not under our control and are provided for convenience only. We are not responsible for their content, policies, or practices.

EXCEPT AS EXPRESSLY PROVIDED, THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURCHASE GREEN AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless Purchase Green, its affiliates, and their respective officers, directors, employees, and agents from and against any claims arising out of or related to your use of the Services or violation of these Terms or applicable law.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute shall be resolved through binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, in San Francisco County, California, unless otherwise required by law. YOU WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. If you prefer not to agree to arbitration, you may opt out within 30 days of first accepting these Terms by emailing [email protected] with subject “Arbitration Opt-Out.”

By providing a phone number or email, you consent to receive communications (including marketing) from us. You may opt out of marketing emails by using the unsubscribe link and opt out of SMS by replying STOP. Message and data rates may apply.

We may modify or discontinue the Services (in whole or part) at any time. We may also update these Terms as described in Section 1.

If any provision is found unenforceable, the remaining provisions will remain in effect. You may not assign these Terms without our prior written consent. Our failure to enforce a right is not a waiver.
